Warranty and Limitation of Liability
At Bailey Hardware & Hydraulic Fittings Inc., our warranty is solely based on the certification provided on the packing slip accompanying the products you have purchased. Our liability, if any, for any breach of this certification or warranty is limited to either replacing the non-conforming part or issuing a credit, up to the invoice value of the non-conforming part.
Apart from the above warranty, Bailey Hardware & Hydraulic Fittings Inc. makes no other representations or warranties, express or implied, regarding the quality or fitness of the products included in your order. We explicitly disclaim all other warranties, including the implied warranties of merchantability and fitness for a particular purpose. Furthermore, Bailey Hardware and Hydraulic Fittings disclaims any liability arising from negligence, tort, or any other legal basis, and the buyer hereby waives any claims against Bailey Hardware and Hydraulic Fittings in connection with this sale or the products sold herein.
In no event shall Bailey Hardware & Hydraulic Fittings Inc., its affiliates, directors, officers, employees, agents, or content or service providers be liable for any indirect, special, incidental, consequential, exemplary, or punitive damages directly or indirectly related to the use or inability to use the products purchased from Bailey Hardware & Hydraulic Fittings Inc.. This includes but is not limited to, loss of revenue, anticipated profits, business, sales, or the cost of substitute services. Even if Bailey Hardware & Hydraulic Fittings Inc. or its representative has been advised of the possibility of such damages, our liability is limited to the maximum extent permitted by law. Please note that some jurisdictions do not allow the limitation or exclusion of liability, so certain limitations may not apply to you.
In no event shall the total liability of Bailey Hardware & Hydraulic Fittings Inc. to you for all damages, losses, and causes of action (whether in contract, tort, negligence, or otherwise) arising from your use of our products exceed the total cost of the materials purchased from Bailey Hardware & Hydraulic Fittings Inc..
